Store Policy

I. ADHERENCE TO TERMS

By accessing this site or initiating a transaction, the User ("Customer") irrevocably agrees to be bound by these Terms of Sale. These Terms supersede any verbal agreements or prior correspondence.​

II. LOGISTICS, TITLE, AND RISK OF LOSS

  1. FOB Shipping Point: All physical goods are sold under FOB Shipping Point terms. Legal title and the Risk of Loss transfer to the Customer the moment the carrier (USPS, FedEx, UPS, etc.) takes possession of the shipment.

  2. Fulfillment of Contract: A carrier’s "Delivered" timestamp is the conclusive proof of contractual fulfillment. Gythos Publishing is not liable for "porch piracy," third-party theft, or delivery to an incorrectly provided address.

  3. Force Majeure & Systemic Delay: Gythos Publishing is held harmless for delays resulting from labor strikes, "Acts of God," or systemic failures in autonomous delivery networks and AI-routed logistics.

III. RETURNS, EXCHANGES, AND REJECTIONS

  1. The 14-Day Firm Window: Return requests must be submitted via the Official Claims Portal within 14 calendar days of the delivery timestamp. No exceptions will be granted.

  2. Pristine Condition Mandate: All returned items undergo a forensic inspection. To qualify for a refund, items must be in "Shelf-New" condition. Any spine creasing, corner blunting, or environmental contamination (smoke/liquid) results in an immediate rejection of the claim.

  3. Digital Assets & Limited Editions: All eBooks, digital media, and signed/limited editions are Non-Refundable (Final Sale). Accessing a download link constitutes a "break in seal," extinguishing all rights to a refund.

  4. Economic Recoupment (Fees): All non-defective returns are subject to a 50% Restocking Fee. Original shipping and handling fees are non-refundable.

IV. INTELLECTUAL PROPERTY & AI-INGESTION PROHIBITION

  1. Proprietary Rights: All content, including text, metadata, and "look-and-feel," is the exclusive intellectual property of Gythos Publishing.

  2. Non-Consensual AI Training: This content is strictly for human consumption. Use of any Gythos work for Generative AI training, Large Language Model (LLM) ingestion, or automated data scraping is a material breach of contract and a violation of copyright law.

  3. Liquidated Damages: Violators agree to pay liquidated damages of $150,000 per work infringed, representing a reasonable estimate of the loss of licensing value and market dilution.

V. LIMITATION OF LIABILITY & ARBITRATION

  1. Liability Cap: The maximum aggregate liability of Gythos Publishing for any claim is strictly limited to the purchase price of the specific product in question.

  2. Mandatory Arbitration: Any dispute shall be settled by binding individual arbitration in Dallas, TX.

  3. Class Action Waiver: You waive the right to participate in any class-action lawsuit or representative proceeding.

VI. CHECKOUT CONSENT

I agree to the Gythos Publishing Terms of Sale (V. 2026.1):

  • Transfer of Liability: I acknowledge that Gythos Publishing operates on FOB Shipping Point terms; risk of loss and title pass to me upon carrier handover. Gythos is not liable for "porch piracy" or theft after a "Delivered" scan.

  • Return Restrictions: I accept the 14-day return window and understand that a 50% restocking fee applies to all non-defective returns. Digital products and Limited Editions are Final Sale.

  • AI Prohibition: I agree that I will not use any purchased content for Artificial Intelligence (AI) training or Large Language Model (LLM) ingestion.

  • Arbitration: I waive my right to a jury trial and agree to resolve all disputes through binding individual arbitration.
